- Primero. DEJAR SIN EFECTO la actuacion posterior al auto del 23 de agosto de 2007 (inclusive) proferido por la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura dentro de la accion de tutela de la referencia.
- Segundo. REMITIR a la Sala Jurisdiccional Disciplinaria del Consejo Superior de la Judicatura, a fin de que asuma el tramite de la impugnacion que le fuera concedida a las sociedades AVIANCA y SAM desde el 18 de julio de 2007 y profiera la decision de segunda instancia que corresponda, conforme a las previsiones del articulo 86 de la Constitucion Politica y del Decreto 2591 de 1991.
- Tercero. Por Secretaria General, comuniquese a los despachos judiciales en colision la decision adoptada en esta providencia, con el fin de que tengan conocimiento sobre lo aqui resuelto por la Corte Constitucional en relacion con el conflicto de competencia.
